  1. Introduction & Agreement
    These Terms and Conditions (‘Terms’) govern the contractual relationship between Trip Nest Travel
    (‘Company’, ‘we’, ‘us’, ‘our’) and any individual, group, or entity (‘Client’, ‘Traveller’, ‘you’) who makes an
    inquiry, booking, or payment for any travel service offered by the Company. These Terms are enforceable
    under the Indian Contract Act, 1872 and are supplementary to the Consumer Protection Act, 2019. By
    completing a booking or making any payment, the Client confirms unconditional acceptance of these
    Terms.

  2. Booking Process & Confirmation
    A booking is considered confirmed only upon receipt of a written confirmation from Trip Nest Travel along
    with the required advance payment (as specified in Clause 3). Verbal or informal agreements shall not
    constitute a binding booking. The Company reserves the right to decline any booking at its sole discretion
    without assigning a reason.
  • Bookings may be initiated via WhatsApp, email, Instagram DM, or the Company website.
  • A formal quotation will be issued within 24-48 business hours of an inquiry.
  • Booking is confirmed only upon written acknowledgement and advance payment receipt.
  • Any changes to the itinerary after confirmation are subject to the Amendment Policy (Clause 14).
  • The Company will issue a Booking Confirmation document specifying all agreed services, cost, and
    dates.
  1. Payment Terms

  • All payments are to be made in Indian Rupees (INR) only.
  • Accepted payment modes: UPI (GPay, PhonePe, Paytm), Bank Transfer (NEFT/IMPS/RTGS), and
    payment links issued by the Company.
  • GST is applicable on all services as per prevailing rates under the GST Act, 2017. Tour services attract
    5% GST (without Input Tax Credit) or 18% (with ITC) as elected by the Company.
  • Payments made via third-party platforms are subject to their respective transaction fees, which shall be
    borne by the Client.
  • A GST-compliant invoice with SAC Code 998555 (Tour Operator Services) will be issued upon full
    payment.
  1. Inclusions & Exclusions
    All inclusions and exclusions specific to a package will be clearly stated in the Booking Confirmation
    document and the itinerary shared at the time of booking. Unless explicitly stated as ‘included’, the
    following items are generally excluded from all packages:
  • Airfare, train tickets, or any inter-city transportation not listed in the itinerary.
  • Personal expenses including laundry, minibar, room service, tips, and gratuities.
  • Entry fees to monuments, national parks, or restricted area permits unless specifically included.
  • Travel insurance premiums (strongly recommended but sold separately).
  • Expenses arising from delays, cancellations, or unforeseen circumstances beyond the Company’s
    control.
  • Any services not explicitly mentioned in the Booking Confirmation document.
  • Inner Line Permits (ILP) for Arunachal Pradesh or similar restricted zone permits (facilitation available at
    cost).
  1. Liability & Responsibility
    Trip Nest Travel operates as a travel facilitator and, in certain cases, as a tour operator. The Company
    arranges services through third-party vendors including but not limited to hotels, transport providers,
    guides, and DMC (Destination Management Company) partners. While every reasonable precaution is
    taken to ensure quality, the Company’s liability is limited to the extent permitted under Indian law.
  • The Company is not liable for loss of life, injury, illness, loss of baggage, or personal property.
  • The Company is not responsible for delays, disruptions, or sub-standard services delivered directly by
    third-party vendors.
  • The Company’s maximum financial liability to any Client shall not exceed the total amount paid by the
    Client for the specific booking.
  • Clients are strongly advised to obtain comprehensive travel insurance prior to departure. The Company
    is not liable for costs that would have been covered by travel insurance.
  • The Company shall not be held responsible for any loss arising from force majeure events as defined in
    Clause 6.
  1. Force Majeure
    Neither the Company nor the Client shall be held in breach of this agreement if performance is rendered
    impossible or impractical by events outside their reasonable control. Such events include, but are not
    limited to: natural disasters (earthquakes, floods, landslides, cyclones), acts of war or terrorism,
    government-imposed travel restrictions or curfews, epidemic or pandemic declarations, road closures, and
    strikes or civil unrest.
    In the event of force majeure, the Company will endeavour to recover amounts from vendors and relay
    recoverable funds to the Client after deducting any irrecoverable costs. No full refund is guaranteed under
    force majeure unless the vendor(s) provide the same to the Company.
    Northeast India Note: Given the unique geography of Northeast India, landslides, road blockades, and
    weather disruptions are common during monsoon (June-September). Clients are advised to purchase
    travel insurance and plan with flexibility during these periods.
  2. Traveller Conduct & Obligations
  • All travellers must carry valid government-issued photo identification (Aadhaar Card, Passport, Voter ID)
    throughout the trip.
  • Inner Line Permits (ILP) and Protected Area Permits (PAP) required for destinations in Arunachal
    Pradesh, Manipur, and similar restricted zones must be obtained in advance. The Company can
    facilitate this at cost.
  • Travellers are expected to respect local customs, traditions, and environmental regulations. Disruptive or
    illegal behaviour will result in exclusion from the tour without refund.
  • Travel insurance is strongly recommended for all trips, particularly those involving trekking, adventure
    activities, or international travel.
  • The Company reserves the right to modify the itinerary at any point due to safety concerns, road
    conditions, or force majeure, without liability to the Client.
  • Minors (below 18 years) must be accompanied by a parent or legal guardian, or the Company must
    receive a notarised consent letter.
  1. Health, Safety & Documentation
  • The Client is responsible for informing the Company of any pre-existing medical conditions before
    booking.
  • High-altitude destinations (Sikkim, Arunachal Pradesh, etc.) carry inherent health risks. Clients with
    cardiovascular or respiratory conditions must obtain medical clearance from a qualified physician.
  • The Company will not be responsible if a Client is denied boarding, entry, or service due to invalid or
    missing documents.
  • In the event of a medical emergency, the Company and its ground staff will assist to the best of their
    ability, but all medical costs are the Client’s sole responsibility.
  1. Intellectual Property
    All itineraries, content, images, branding materials, and documents produced by Trip Nest Travel are the
    intellectual property of the Company and are protected under the Copyright Act, 1957. Clients may not
    reproduce, redistribute, or commercially exploit any material without prior written consent.
  2. Dispute Resolution & Governing Law
    Any dispute arising from or in connection with this agreement shall first be subject to good-faith negotiation
    between the parties. If unresolved within 30 days, disputes shall be referred to mediation or arbitration as
    per the Arbitration and Conciliation Act, 1996. The courts of Alipurduar or Jalpaiguri, West Bengal, shall
    have exclusive jurisdiction over all unresolved disputes. These Terms are governed by the laws of the
    Republic of India.
    Consumer Rights: Clients retain all rights under the Consumer Protection Act, 2019. If dissatisfied with
    resolution, you may file a complaint with the District Consumer Disputes Redressal Commission,
    Alipurduar.
